1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and ChefLink ("Company", "we", "us", or "our"), concerning your access to and use of the ChefLink platform. You agree that by accessing the Platform, you have read, understood, and agreed to be bound by all of these Terms of Service.

If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Platform and you must discontinue use immediately.

2. Intellectual Property Rights

2.1 Our Content

Unless otherwise indicated, the Platform is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Platform (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

2.2 Your Content

By posting content to the Platform, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Platform. You retain any and all of your rights to any content you submit, post or display on or through the Platform and you are responsible for protecting those rights.

2.3 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform strictly in accordance with these Terms of Service. As part of this license, you may not: (a) reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our Platform; (b) use any illustrations, photographs, video or audio sequences or any graphics separately from the accompanying text; (c) delete or alter any copyright, trademark or other proprietary rights notices from copies of materials from this site.

3. User Representations

By using the Platform, you represent and warrant that:

All registration information you submit will be true, accurate, current, and complete.
You will maintain the accuracy of such information and promptly update such registration information as necessary.
You have the legal capacity and you agree to comply with these Terms of Service.
You are not a minor in the jurisdiction in which you reside.
You will not access the Platform through automated or non-human means, whether through a bot, script or otherwise.
You will not use the Platform for any illegal or unauthorized purpose.
Your use of the Platform will not violate any applicable law or regulation.

4. User Registration

4.1 Account Creation

You may be required to register with the Platform. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

4.2 Account Termination

We reserve the right to terminate your account at any time and for any reason, including but not limited to violation of these Terms of Service. Upon termination, your right to use the Platform will immediately cease.

4.3 Account Security

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else.

5. Prohibited Activities

You may not access or use the Platform for any purpose other than that for which we make the Platform available. The Platform may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Platform, you agree not to:

Systematically retrieve data or other content from the Platform to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
Make any unauthorized use of the Platform, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email.
Use the Platform to advertise or offer to sell goods and services.
Circumvent, disable, or otherwise interfere with security-related features of the Platform.
Engage in unauthorized framing of or linking to the Platform.
Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
Make improper use of our support services or submit false reports of abuse or misconduct.
Engage in any automated use of the system, such as using scripts to send comments or messages.
Interfere with, disrupt, or create an undue burden on the Platform or the networks or services connected to the Platform.
Attempt to impersonate another user or person or use the username of another user.
Use any information obtained from the Platform in order to harass, abuse, or harm another person.
Use the Platform as part of any effort to compete with us or otherwise use the Platform and/or the Content for any revenue-generating endeavor or commercial enterprise.

6. Limitation of Liability

6.1 Disclaimer

The Platform is provided on an as-is and as-available basis. You agree that your use of the Platform and our services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Platform and your use thereof.

6.2 Liability Cap

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Platform, even if we have been advised of the possibility of such damages.

7. Governing Law

These Terms of Service and your use of the Platform are governed by and construed in accordance with the laws applicable to agreements made and to be entirely performed within the jurisdiction in which ChefLink operates, without regard to its conflict of law principles.

8. Changes to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Service, and you waive any right to receive specific notice of each such change.

It is your responsibility to periodically review these Terms of Service to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Service by your continued use of the Platform after the date such revised Terms are posted.
